Assumption of Risk, Waiver of Liability & Release Agreement

I, the undersigned, on behalf of myself and any minor child(ren) for whom I am the parent or legal guardian, agree to the following:

I understand that participation in activities at ROC Kid City LLC (“ROC Kid City”) involves inherent risks, including but not limited to bodily injury, illness, permanent disability, paralysis, and death.

These risks may arise from use or misuse of equipment, facility conditions, or the actions of other participants.

I voluntarily choose to participate, and/or allow my minor child(ren) to participate, in activities at ROC Kid City.

I understand that parent or guardian supervision is required at all times and is my sole responsibility.

I knowingly and freely assume all risks, both known and unknown, including those that may arise from negligence, and accept full responsibility for any injury, loss, or damage.

I understand that ROC Kid City does not provide child supervision.

I agree that I am solely responsible for the supervision, safety, and behavior of my child(ren) at all times while on the premises.

I understand that ROC Kid City is not responsible or liable for incidents involving elopement, wandering, abduction, kidnapping, false imprisonment, or similar acts involving any child or participant.

I voluntarily agree to fully release, waive, discharge, indemnify, defend, and agree not to sue ROC Kid City LLC, its owners, employees, and affiliates from any and all claims arising from such incidents.

I acknowledge that I have read and agree to follow all ROC Kid City rules, policies, and procedures.

I understand that ROC Kid City reserves the right to deny, suspend, or terminate access to any individual for non-compliance, unsafe behavior, or violation of policies.

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless ROC Kid City LLC, its owners, employees, agents, and affiliates (“Released Parties”) from any and all claims, liabilities, damages, or expenses arising from:

• Personal injury, illness, or death
   
• Property damage, loss, or theft
   
• Participation in activities or use of facilities
   

This includes claims arising from the negligence of the Released Parties, to the extent permitted by New York law.

I agree to indemnify, defend, and hold harmless ROC Kid City from any claims, demands, or causes of action brought by or on behalf of myself, my child(ren), or any third party arising from our actions or participation.

I agree to be financially responsible for any damage to property or equipment caused by my actions or the actions of my child(ren), whether due to negligence, misuse, or intentional conduct.

I understand that ROC Kid City does not provide medical or health insurance. I am solely responsible for any medical or health-related expenses incurred.

I agree that any disputes arising from this agreement shall first be attempted to be resolved through good-faith mediation.

If unresolved, disputes shall be governed by the laws of the State of New York, and the prevailing party shall be entitled to reasonable attorney’s fees and costs.

I grant ROC Kid City permission to use photographs and/or videos taken on the premises that may include myself or my child(ren) for marketing, advertising, and promotional purposes, including but not limited to social media, website content, and printed materials.

I waive any right to compensation and release ROC Kid City from any claims related to such use.

I understand that this waiver includes claims that I may not currently know or suspect to exist and expressly waive any rights under laws that limit such releases.

This agreement is binding upon myself, my child(ren), and my heirs, assigns, and legal representatives.

I HAVE READ THIS AGREEMENT CAREFULLY AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.
